By using Bananix ("the Service"), you agree to these Terms of Service. Please read them carefully.

1. Service Description

Bananix is an AI-powered photo editing and generation service. Users can upload photos, write text prompts, and receive AI-processed images.

2. Account Registration

• You must sign in with a valid Telegram account.
• You are responsible for maintaining the confidentiality of your account.
• You must be at least 13 years old to use the Service.

3. Credits and Payments

• The Service uses a credit-based system.
• Credits are consumed for each AI generation based on the selected model.
• Credits are non-refundable except as required by law.
• Payments are processed by CloudPayments, a third-party PCI-DSS compliant provider.

4. Acceptable Use

You agree NOT to use the Service to:

• Generate illegal, harmful, or offensive content
• Create deepfakes of real people without consent
• Generate sexually explicit content involving minors
• Violate intellectual property rights
• Harass, threaten, or impersonate others
• Distribute malware or engage in fraudulent activity
• Reverse engineer or attempt to extract our AI models

Violation of these rules will result in account suspension or termination.

5. Content Ownership

• You retain all rights to images you upload.
• You grant us a limited license to process your images for the purpose of providing the Service.
• AI-generated images are owned by you, subject to applicable AI provider terms.
• We do not claim ownership of generated content.

6. Content Moderation

We use automated and manual moderation to detect prohibited content. We reserve the right to:

• Remove generated content that violates our policies
• Refuse or block prompts that violate AI provider safety rules
• Suspend accounts for repeated violations

7. Service Availability

• We strive for 24/7 availability but do not guarantee uninterrupted service.
• We may temporarily suspend the Service for maintenance.
• We are not liable for damages caused by service interruptions.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee:

• Specific results from AI generation
• Suitability for any particular purpose
• Accuracy or quality of generated content

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim related to the Service shall not exceed the amount you paid us in the last 12 months.

10. Account Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Required by law

You may delete your account at any time through Settings.

11. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by applicable laws of the user's country of residence.
